TERMS AND CONDITIONS

REQUIREMENTS 

The renter shall present his rental voucher, an original, valid driving license, together with an identity card or passport for collection of the vehicle.
Valid driving licenses of all EU countries are accepted.
Driving Licenses printed with non-Roman Alphabet (Arabic, Japanese, and Cyrillic) must be accompanied by a valid International Driving Permit in English Language.

PAYMENT

Payments can be done using a debit or credit card.

We do not accept American Express, Maestro, Diners, prepaid cards, and cash.

The hirer must present a Credit Card for the Excess Block and Car Deposit. 

In the case where a customer has a Debit Card, it can only be used when purchasing the company’s Medium or Total protection plans which reduces the excess liability block and has a low vehicle deposit. 

Accepted cards stated above must be in the main driver’s name with sufficient funds available to cover the excess liability and deposit. Failure to provide a valid card may result in the booking being canceled and no funds for the prepaid amount reimbursed.

AGE REQUIREMENT

The minimum age for every driver is 21 years having held the driving license for at least 1 year. The maximum age for every driver is 75 years. 

Drivers Over 70-71 years and Drivers between 21-25 years will have a fee of €10 per day.  

DRIVERS.

There will be the main driver, and you can add up to three additional drivers with an additional fee of €7 per day. Only undersigned drivers in the contract can drive the vehicle, Insurance cover will not be applicable in case of someone else driving the rented vehicle.

GENERAL INFORMATION

All bookings are subject to our terms and conditions. By confirming the booking, the customer acknowledges having read and accepted these terms and conditions. The vehicle shown on any documentation is for guidance only and may be substituted with an alternative, similar or upgraded vehicle at the company’s discretion. The rental is calculated on a 24hr basis from the vehicle pick-up time. All transactions are subject to vat. Any extras can be purchased locally at the rental office. Any bookings that were placed due to a technical error, affecting either the price and/or booking inclusions might be canceled. In these cases, customers will be notified and a full refund will be issued to the customer. If the customer chooses not to purchase any insurance cover offered by the hire company, he solely is responsible for any damages to the hired vehicle and any costs incurred during the rental period.

OPERATING HOURS

We operate from the airport premises, 24hrs a day 7 days a week. An out-of-hours charge of €25 will be charged for all bookings collected outside the standard operating hours and on the Public Holidays of Malta. Out-of-hours services are treated as on request, the customer is requested to provide flight details and contact number. After midnight 00:01 to 08:59 the out-of-hours rate is €40. Standard opening hours are Monday to Friday 09.00 – 18.00, Saturday  09.00 – 13.00, Sunday on request.

DELAYED COLLECTIONS/ NO SHOW POLICY

Reservations will be held 59min  from the specified reservation time after which they will become a no-show. It is the responsibility of the hirer to inform the office of any delays. In the event of a no-show, the booking is non-refundable. If the hirer arrives after this time or if the rental office closes, then a vehicle is not assured. This may include offering a different vehicle and rates may be different from the original booking.

OUR RATES INCLUDE

Third-party insurance, unlimited mileage, 24/7 breakdown call assistance, road licensing fees, vehicle maintenance.

OUR RATES EXCLUDE

Excess waiver options, fuel, hire of extra equipment, satellite navigation systems, fines, parking tickets, controlled vehicle access entrances and anything related to the hired vehicle circulation in the rental period.

FUEL POLICY

We operate a prepaid fuel policy whereby cars are supplied with a half or a full tank of fuel. Renters are advised to return vehicles empty as no refunds are given for unused fuel at the end of the rental.

EXTRA SERVICES

Additional Driver: €7 per day

Baby seat: €6 per day

Booster seat: €5 EUR per day

Child seat: €6 per day

GPS: €8 per day

Installation of Baby / Child Seats

Responsibility for the installation of child/ baby seats is of the hirer. This is due to liability in case of inappropriate installation.

PREMIUM LOCATION SURCHARGE

Airport Surcharge applies to all bookings which are collected from Malta Airport. The price of the surcharge will be €25.00

CROSS BORDER TRAVEL

Vehicles are permitted to cross to Gozo island only. If the vehicle must be recovered in case of breakdown from Gozo, the company will charge the Customer all expenses incurred in the recovery of the vehicle, including but not limited to tow-truck costs, ferry charge, Loss of Use Fee, and any additional costs being generated by this event. Vehicles cannot leave the Maltese Islands in any case that can arise and Insurance covers do not apply outside the islands of Malta and Gozo.

DELIVERY / COLLECTION SERVICE TO LOCATION

This is possible upon request; this service charge is €50 depending on the location and time of delivery/collection.

RENTAL EXTENSIONS

Where the customer wishes to extend the rental, he is to contact the rental office, and confirmation by email must be done between the parties with the agreed price, new date, and time of vehicle drop off. The rental will be charged at the prevailing rate which may be higher or lower than the original booking rate. A rental contract is valid for up to 30 days, after which a new contract must be issued if the renter wishes to keep the vehicle for a longer rental. 

VEHICLE LATE RETURN

If the hirer fails to return the vehicle within the specified time, a courtesy time of 59 mins is given, after which a full day’s rental will be charged. Additional collection fees and loss of use fee charges may also be applicable if a vehicle is returned late without prior notice.

The same clause will apply to rentals terminated at a different location than stipulated on the rental contract. Charges will be withdrawn from the card provided for the security deposit. No refunds will be given for rentals ended early, late collections, no shows, or cancellations made after the rental start date.

ABANDONED VEHICLE

An abandoned vehicle fee of €100 will be applied including any towing fees that might be needed in order to retrieve the hired vehicle and return it to its original designated drop-off location in the Malta International Airport car rental parking.

LOSS OF USE

A fee of €100 applies if the vehicle becomes out of use for more than 2hrs from the drop-off stipulated time of the contract.

CANCELLATION OF BOOKINGS.

Bookings can be cancelled with a full refund up to 24 hours before the rental starts.

If a customer decides to cancel the car rental reservation on the collection, or fails to present the required documentation for rental, or does not comply with any of the companies T&C, the customer will be charged a cancellation fee of €50.

Once a booking is paid and the rental agreement is signed by the customer there will be no refunds made for the car rental fee and insurance fee or any other fees paid.

AMENDMENTS

All amendments to the booking must be done by contacting us at reservations@nexarent.com Amendments are free of charge up to 24hrs before the vehicle pick-up time, after which a fee applies.

SMOKING POLICY

A strict no smoking policy is in place for all vehicles.  If you have smoked or allowed smoking within the vehicle, charges will apply.

ANIMALS IN VEHICLES

No animals should be transported in the vehicles unless contained. A valeting fee will apply.

FLAT AND PUNCTURED TIRES

The 24hr road assistance contractors do offer the service of tyre replacement with the spare wheel. A call-out fee will apply, excluding the costs for repairs/ replacements to the hired vehicle tires and rims. 

24/7 BREAKDOWN AND TOWING SERVICE

The breakdown assistance plan can be purchased at €5 per day, this eliminates the costs of a tow truck where needed, excluding the costs for repairs/ replacements to the hired vehicle.

LOSS OR REPLACEMENT OF KEYS

A charge will apply if keys are lost or damaged. Delivery of the second key applies.  Please note that if a vehicle is stolen and keys are not returned to the rental office, the hirer will be deemed negligent. Lost keys are deemed as negligence and are not covered by insurance. Hirers will be liable for all costs relating to recovery, repair, and a charge for loss of use of the vehicle may also apply since the vehicle cannot be rented out without a spare key.

FINES, PARKING TICKETS, PENALTIES, AND ADMINISTRATION CHARGES

It is the responsibility of each hirer to pay any fines, contraventions, parking tickets, or Controlled Vehicle Access parking within 48hrs after the issue time. The hirer is to present the contravention/ parking ticket to the rental agent when dropping off the vehicle at the location. If a customer provides proof of the payment of the traffic fine no amount will be charged by the Lessor but if the rental office is involved in administering the charge, then an administration fee of €60 will be charged to the hirer from the security deposit. Contraventions that incur penalty point transfers have an administration fee of €90. 

CONDITION OF VEHICLE UPON COLLECTION

The vehicle must be returned clean in the same condition as when rented except for expected dust and a little dirt. If the vehicle is dirty, it cannot be inspected for scratches and damages. The vehicle will first be sent for a car wash at the customer’s expense cost of €20, only after cleaning the vehicle inspection form will be completed.

CONDITION OF VEHICLE UPON RETURN 

We insist on providing you with a high level of service, but we know that sometimes things might go wrong. If You have a Complaint about your rental, we want to hear about it so we can make things better. We take customer service seriously and commit to dealing with complaints fairly and thoroughly. SPECIAL CLEANING

A cleaning fee will apply for cars returned excessively dirty, smelly, with wet upholstery and/or excessive dirt and stains requiring special cleaning. The special cleaning fee is €90 for the interior of the vehicle, and €50 for the exterior of the vehicle. Hazardous or excessive soiling found on the body of the vehicle that requires vehicle polish costs €250.

DAMAGES ON THE HIRE VEHICLE

At the end of their rental, customers are advised to check the vehicle for any damages. New damages found on the vehicle will be charged to the customer according to the Repair Cost Table of the company. In cases where damages are minimal and repair costs amount to less than the excess amount, the renter’s liability will be limited to the actual damage repair cost. Administration Fees and Loss of use will apply.

IN CASE OF DAMAGES OR ACCIDENT 

The Hirer must contact the rental company in case of any road accident or damage to the hired vehicle. Our department will assist the customer and instruct the necessary procedure for legal and insurance requirements. The Hirer will be required to file a police or transport Malta authority report and then visit our office to compile an insurance claim and other required documents. Payment of the excess charge, claim administration fee and repair costs will be required right away. In the event that a customer is involved in an accident during the hire period, a replacement vehicle is not guaranteed, T&C apply.

Failure to complete the necessary documents in case of damage or accident, at the first possible time may automatically void insurance cover making the renter liable for all repair costs of the rented car and third parties, including loss of use of the vehicle whilst it is being repaired.

EXCESS DEPOSIT

The Company will require an excess deposit to be pre-authorized on the credit card of the main driver. A pre-authorization is the method by which a deposit amount is blocked rather than transacted as a sale. The amount will not be available to the account holder until released by their bank, between 15 and 30 working days but can be longer depending on the type of card and country of issue. Excess Deposit is according to the vehicle category hired. Car Groups A have an excess of €1300, B has an excess of €1600, group C €1800, group CW and D €2000, group E to J have an excess of €2500 whilst groups K have an excess of €3000.

VEHICLE SECURITY DEPOSIT 

In case of parking tickets, speeding fines, contraventions, controlled vehicle access, and anything related to the vehicle circulation, a deposit of €200 is blocked on the hirer’s credit card.

WAIVER AND PROTECTION OPTIONS

The company offers 3 different packages with different levels of protection/coverage. The standard excess is the cheapest but has the highest Damage and Theft excess amounts, Medium Protection reduces your liability in case of accident or damages to the hired vehicle, and the  Total Protection is the most expensive to purchase, but comes with zero excess and a very low-security deposit. The vehicle’s insurance policy is subject to strict terms and conditions. 

Any damage to the following is not covered by any of the protection plans purchased and is payable by the renter: Antenna, trays, car key, damage to car lock, personal belongings, GPS Navigation systems, loss or damage to keys, windshield wipers, glass, mirrors, rear view mirrors, wheels & rims, tires, tire punctures and burst tires, spare key, and a car jack, clutch, engine, hubcap, lights, gas cap, warning triangles, damage to the upholstery of the car, undercarriage, extreme dirtiness in the car, damage due to negligence, wrong refueling, damage to child seats and baby seats, flat battery and anything which is caused due to renters negligence.

COMPLAINTS AND CUSTOMER RELATIONS

All complaints and customer-related issues should be made in writing to customercare@nexacar.rent within 30 days from the last day of your rental. We do our best to resolve all cases brought to our attention within 15 working days.

JURISDICTION / APPLICABLE LAW

The Rental Agreement, Terms and Conditions and Email communication which is an integral part of the Booking Agreement, are governed by the laws of the Republic of Malta and will be interpreted in accordance with the laws of the Republic of Malta. The courts of general jurisdiction of the Republic of Malta shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these Terms and Conditions and the Booking Agreement. DATA PROTECTION

The Company takes care that personal data of the Renter are processed according to the personal data protection requirements applicable in the European Union including the General Data Protection Regulation 2016/679. The Company ensures that the Renter’s personal data will be processed in accordance with lawful business purposes in order to ensure providing the Service requested by the Renter.

By confirming the reservation, and signing the rental agreement, the customer acknowledges having read and accepted these terms and conditions.

NEXACAR RENTALS strongly suggests to all customers of speeding up the process of formalizing the contract and collecting the vehicle, by filling out the ONLINE CHECK-IN Form, which gives the customer the possibility of a fast car collection at the airport parking lot without going through the open office.
